Competition Law in the Realm of Intellectual Ownership (Vol.II): Misuse of Dominant Position, Concentrations and Competition Remedies
In this book, three important categories of competition law in the realm of intellectual property are examined: first, abuse of dominant position, which the firms with market power and effective intellectual property carry out, and sometimes this abuse disrupts the markets associated with intellectual creation; Second, the rules of focusing, which are mainly crystallized in the form of mergers and acquisitions of commercial companies and in some cases, due to a significant reduction in competition, become the source of monopoly and hinder the promotion of innovation and technological development, and third, the nature and duties of competition authorities By using the guarantee of competitive performances, they cope with the destructive procedures of competition in the field of intellectual property, in order to ensure the continuous improvement of dynamic economic efficiency and the provision of consumer rights. In this book, an attempt is made to adapt the approaches of the leading systems in the field of competition law and intellectual property and the results to the approaches of Iranian law in an analytical and critical perspective, to achieve the researcher’s educational goals and solutions and suggestions for lawyers and trustees in the areas of competition law and intellectual property rights.
