Jurisprudential Study of Obedience and Civil Disobedience
Resistance and civil disobedience against a government policy, law or decision” by accepting the principle of government and taking care of it, is the main subject of this research. Do the people have such a right or obligation in the legitimate Islamic government and the unjust government? While in the common theories of political philosophy and various principles of political obligation, it is difficult to justify such a right, according to the principles of Shiite jurisprudence, in some circumstances, this right, and even duty is fixed. Not only in an unjust government but also in the legitimate government, one can resist policies, laws, and decisions of the government which are against sharia, justice, and the public interest. The jurisprudential reasons and documents of this right are presented in this book. The verdict of “civil resistance and disobedience” is the focus of one of the chapters of this book in cases where the secondary titles of “disruption of the social system” or “weakening the foundation of the Islamic State” or “harming others” coincide with it. The “reference of discernment” of the accordance and discordance of a policy, law, or decision contrary to Sharia, justice, and public interests, and the recognition of the truth of the above-mentioned secondary topics is the subject of another chapter of this book.
