Prisoner of War in Islam: A Historical-Legal Survey (War, Captivity, Slavery)
Due to the innate antagonism and contradiction that is institutionalized in human nature in terms of its material element, conflict, war and struggle have existed more or less in all human societies since the beginning of human creation. One of the great problems of any war is the miserable issue of captivity and, consequently, the complex problem of slavery and servitude. The book “The Fate of the Captive in Islam” describes the subject of war and jihad, captivity and captive, slavery and servitude in historical and jurisprudential terms in Islam and expresses the final view of Islam about them. The features of the present book are the comprehensiveness and universality of the topics and the study of the history of war, captivity, slavery, and also addressing the abolition of slavery, the date of compilation of the Universal Declaration of Human Rights, critiquing its shortcomings and weaknesses, the situation of prisoners in the present age, formation the International Committee of the Red Cross, and prisoners'rights in other schools and prisoners' rights in Islam. Also, the past topics and current ones on captivating are linked. It is worth mentioning that in this book, numerous sources and references are widely used and all its contents are documented and reasoned, and the structure of the book consists of two parts: war and jihad, captivity and slavery, and its conclusion is on captive rights.
